If an apartment purchase is challenged in the seller’s bankruptcy
A buyer needs to identify the legal basis of the challenge and the remedy sought. We review documents concerning apartments in the Moscow Region and prepare objections and supporting evidence. Consultations take place at our Lyubertsy office.
- The claim and dates. Keep the application, attachments, court orders and proof of receipt. Tell us about any scheduled hearing.
- Price and payment. Bring the contract, bank statements, letter-of-credit or other payment records, any valuation and materials used when choosing the property.
- Purchase circumstances. Collect the listing, correspondence with the seller and agents, checks completed before purchase and records of what was known at the time.
- Property handover. Bring the handover deed, registration and occupancy documents. Identify missing records.
Depending on the grounds of the claim, we examine allegations concerning price, actual payment, the buyer’s knowledge and relationships between the parties. Full payment and title registration matter, but do not by themselves guarantee that the transaction will stand.

Does reviewing the seller eliminate future disputes?
No. A review can identify some risks and help preserve evidence, but cannot guarantee that bankruptcy or a challenge will never arise. Registration of title does not replace analysis of the transaction.

Buying an apartment: documents for review

If the transaction is already challenged, also bring the application and attachments, bank statements, handover records and correspondence. Review helps assess risks and prepare evidence but does not guarantee that a transaction will be upheld.
