Dividing a mortgaged apartment: four document questions
- What property is involved? We identify the purchase date, owners, property regime and any marital agreement. Children's and third parties' rights require separate consideration.
- Where did the money come from? We distinguish the deposit, purchase payment and subsequent loan repayments, comparing bank records with evidence of gifts, inheritance or premarital assets.
- What outcome do you seek? We consider ownership shares, compensation and separate monetary claims. One spouse's loan repayments do not automatically increase their ownership share.
- What obligations remain to the bank? We review the outstanding loan, security and contract terms. An agreement between spouses does not by itself amend their obligations to the lender.
An illustrative calculation
If one spouse is proven to have repaid a joint debt using RUB 600,000 of separate funds and the other spouse's obligation is one half, a monetary claim might start from RUB 300,000 rather than the full payment. This is a hypothetical illustration. The source of funds, allocation of obligations, agreements and payment dates all require review under Russian law.
